We do not have jury trials or pain and suffering damages in our workers compensation system. Some people who have workers compensation claims also have third party cases (i.e. cases against third parties that can be litigated in Circuit Court). Our Supreme Court recently reversed an old case and reinstated caps on damages. This takes away the Jury’s ability to decide the appropriate damages based on the facts in a particular case. It is important to note that for the last 17 years we have had no caps and there has been no crisis. If you feel strongly about this, then please call your state senator and tell the staff person who answers the phone that you support SB 487. It will take less than 5 minutes and is painless.
